Wrongful Death Plaintiffs Get $15m For Son's Death

November 16, 2005

A jury A Tampa couple was awarded $15-million by a jury that determined a commercial truck driver who ran into their son on U.S. 41 was at fault in the fatal accident.

The crash happened late one October afternoon nearly two years ago when Jeremy Vaughn, 24, was riding his 1994 Yamaha motorcycle south on U.S. 41. Dade City resident Frank Collura was on his way to get a tire change in an 18-wheel tanker truck when he turned right and cut off Vaughn. Vaughn, who was not wearing a helmet, collided with the right side of the truck's cab and died of his injuries. Collura was not injured, according to a Florida Highway Patrol report filed at the time.

About a year after their son's death, Debra and Joel Vaughn, both 46, filed a lawsuit in Hillsborough Circuit Court against SL Transport of Minnesota, the company that hired Collura to drive. 'They [the defendants] said Jeremy was at fault. We said the truck driver was at fault. Then the jury determined that it was 100 percent the fault of the truck driver,' the Vaughns' attorney said.
