Florida Jury Slams Ford with $10.18M Verdict In Rollover Suit

A Florida jury returned a $10.18 million verdict against Ford in a suit involving an SUV that rolled over in Estate of Claire Duncan v. Ford Motor Co. (01-72320-CA DIV CV-F, Fla., Cir., Duval Co.).

Claire Duncan was driving a 2000 Ford Explorer on I-95 near Petersburg, Va., when another vehicle swerved into her lane, causing her to veer into the median. Duncan lost control of the vehicle, which rolled over five times. Duncan died in the crash.

Duncan's estate sued Ford, claiming that her seat belt spooled out rather than tightening, creating seven inches of slack; in addition, it said, the roof crushed in eight inches. The defense argued that there was no defect in its product, and that Duncan died during the first roll, which was too severe for anyone to survive. The trial lasted for approximately four weeks, and the jury deliberated about 3-1/2 hours before reaching its verdict.
